Mass Torts / Class Actions

When a person is injured by a product or incident, there may be several ways to seek a legal remedy. This is  especially true if other people have been similarly affected. Things like asbestos exposure, medical device recalls, defective prescription drugs, plane crashes, oil spills, and other large-scale disasters are all likely to have many victims. Mass torts refers to individual lawsuits, all against one common defendant. The lawsuits relate to a single common triggering event.

If there is a class action relating to a claim, only a few individuals, known as class representatives, represent the interests of everyone considered to be a member of the class. The court and jury rulings made in a class action can bind all class members. This is true even if they are not aware of the lawsuit and are not named in the litigation. Individuals often have the opportunity to opt out of a class and pursue their claim individually. But there is a limited time to do so. Contact Maxey McFarland Law Firm today for a free consultation if you believe you have been injured by a mass tort and are not sure how to best pursue a claim that you might have.

The law creates legal standards and procedures for claims. You may qualify to bring a claim if you lived or worked at Camp Lejeune between the above-listed dates and have developed serious health issues because of exposure to toxic water. Many health problems are included, including cancer, ALS, birth defects, infertility, heart attacks, thyroid issues, and neurological conditions. Researchers continue to recognize additional conditions as they learn more about the effects of the water contamination at Camp Lejeune.

Asbestos / Mesothelioma

Workplace Asbestos Exposure

Mesothelioma is a rare and usually fatal type of cancer that can only be caused by exposure to asbestos. The companies producing asbestos-based products knew that their products could cause disease for decades. But they concealed the danger and put millions at risk. The asbestos exposure that causes mesothelioma is almost always connected to the workplace.

In South Carolina, we have many of the industries that present a high exposure risk. These include textiles, power generation, mining, construction, automotive repair, and others. If you have received a mesothelioma diagnosis, you should contact Maxey McFarland Law firm today for a free consultation. Many people with asbestos exposure decades ago are only now being diagnosed with mesothelioma. They should contact our firm for a free consultation .

Talc Powders

Asbestos-related illnesses have also been linked to personal care products in addition to workplace exposures. Women have been developing mesothelioma and ovarian cancer after using talc powder or other talc products that were contaminated with asbestos. Baby powder, other talcum powders, and many types of cosmetics can contain talc and be contaminated with asbestos. Johnson & Johnson, a major manufacturer of talc-based products, knew about the asbestos in their products. They spent decades trying to conceal the contamination and the potential harmful effects. If you have developed mesothelioma or ovarian cancer after use of talc-based products, contact Maxey McFarland law firm for a free consultation.
